A factual summary/description of the legal topic. 2. A historical analysis of your legal topic. 3. At least 3 relevant cases that are integral to your legal topic and a brief of each. 4. Give your opinion of the topic, its history, and what you think the future might bring for your topic. 5. A reference page with at least 5 sources. try and narrow down your topic to a manageable size.
For example, express contracts addressing interesting cases you have found, might be too broad, but alternatively covenants not to compete are a narrower topic, especially if you deal with a set of cases that try to define what the limits of restrictions are.
Other topics could use cases we have addressed in class that raise broader issues, like Gucci, for example, dealing with the ability to enforce tradename protection given the constitutional restrictions requiring personal jurisdiction. Another example is the Wayfair case I mentioned in class that deals with restrictions on states that impose a requirement of collecting sales and use taxes from internet sellers when they sell to consumers. This changed the law significantly from previous case precedent and did not follow stare decisis. Still another example might be some defamation cases related to newspaper reporting and the borderline between free speech and defamation.
